He was also criticised by hard line Salafi jihadists for supporting the decision to permit U.S. troops to be stationed in Saudi Arabia in 1991. [End of quote]

Response:

First, we have already established in this series that there is no benefit in saying that an affair is contentious while offering no solid knowledge-based proof to differentiate truth from untruth based on the Qur’an and Sunnah as understood by the Sahaabah.

First, the Prophet [peace and blessings of Allah be upon him] forbade rebellion against Muslim rulers, whether they be pious or sinful, so Imam Abdul Azeez Bin Baaz’s [may Allah have mercy upon him] position on regime change is based on the sound Prophetic narrations. Therefore, there is no discussion of whether their rule is valid or not; rather, Muslims are instructed to consider all Muslim rule as legitimate, regardless of how such a Muslim ruler behaves, and rebellion is prohibited. Imam As-Sadi [may Allah have mercy upon him] stated:

The statement of many materialists (atheists) and those who blindly follow them is that “There should be freedom of thought, everyone should be free to hold the opinion he sees fit and the proposal he makes”. This has also manifested its great harm. Indeed, freedom of thought – giving everyone his freedom (i.e. based on desires) – has shown to be the very reason behind anarchy; rather that is its basis. Animals become better than them (i.e. humankind and Jinn) when they are given freedom in that which corrupts their morals and (sound) beliefs, thus their deeds become chaotic. This is the reality in every country where freedom has been let loose and not restricted by the divine legislated restrictions that conform with (sound) intellect because the souls command evil, incline towards arrogance and insolence, and approach every desire whether it harms individuals and groups or not. Just as giving one the freedom to do as he pleases unrestrictedly cannot remain because if everyone was left with his freedom that he can murder, injure or hit, or take the wealth of the people or violate their honour, the state of affairs would have been corrupted, the world would be in anarchy, chaos, disturbance and great harm will occur; likewise, the freedom of thought has brought evil, and from its filthy fruits is dispensing with religion and the Messengers [peace and blessings of Allah be upon them], rejecting what they brought and that which sound intellect indicates, such as the obligation of restraining and guarding oneself against the harmful affairs related to creed, morals and deeds. Among the outcomes of freedom of thought are the statements heard from the atheistic and vile newspapers that shake the hearts of the people of sound intellect, and indeed they have done great harm to the beliefs and morals; rather it has harmed governments, groups and individuals. As for the Islamic legislation, then indeed it – and praise be to Allāh – came to alert the intellects and urge towards (sound) reflection on those affairs that are useful for one to reflect on, such as the signs Allah has created in the creation and the signs conveyed in the divine revelation; pursues the sound paths of reflection and examining them, and thus it affirms the beneficial sciences and truthful understandings- urges towards every beautiful character, warns against every evil character and places a sound restriction on ideas, which if encroached will result in destructive things and various types of misguidance. If ideas are not restricted by sound intellects and religion – which Allāh has provided for the servants in which is the rectification of their affairs and perfection of their circumstances, then indeed they give birth to chaos and error, misguidance, misery, folly and insanity.

The anonymous writers at Wikipedia stated, “In 1927 when he was sixteen, he started losing his eyesight after a serious infection in his eyes. By the time he was twenty, he had totally lost his sight and had become blind. At that time, Saudi Arabia lacked a modern university system. Ibn Baz received a traditional education in Islamic literature with Islamic scholars”. [End of quote]

First of all, the Salafus Saalih (pious predecessors), the best generations of this Ummah, did not receive their Islamic education from contemporary educational systems, despite the fact that they and their successors were the ones who established solid foundations of Islamic knowledge in numerous regions of the world before contemporary universities were established in the Ummah. The Masjid of the Messenger in Madeenah and many other Masaajid in the Islamic Ummah produced scholars far greater than Imaam Abdul Azeez Bin Baaz even though there were no modern universities in the Ummah at the time. Likewise, the Imaam himself – an Imam of knowledge and piety – is a manifest proof of the blessed traditional system of Shariah knowledge.

As a result, the lack of contemporary universities had no detrimental effects on the results of knowledge and scholarship; rather, the traditional system produced the greatest Erudite Scholars, whose knowledge has never been equalled. Imam Ibn Rajab Al-Hanbali [may Allah have mercy upon him] stated, “There is not to be found in the statements of those who came after the Salaf (any) truth, except that it is found in their statements with a more concise wording and a shorter expression. There is not to be found in the statements of those who came after them (any) falsehood, except that there is in their statements that which clarifies its falsity, for the one who understands and contemplates [i.e. the one who understands the statements of the Salaf]. There are wonderful meanings found in their statements and precise observations, which those who came after them were neither guided to nor knew about. The one who does not take knowledge from their statements will miss all that goodness, alongside the numerous (affairs) of falsehood he will fall into due to following those who came after them [i.e. those who came after the Salaf]”. [(2)]

Likewise, it was the traditional systems that produced the likes of the great Mujaddideen, such as Shaikh Al-Islam Ibn Taymiyyah, Imaam Ibn Al-Qayyim, Imaam Muhammad Ibn Abdil Wahhaab, and others [may Allah have mercy upon them].

Second, when institutions of Shariah knowledge other than Masaajid were initially formed, the upright Scholars reminded seekers of knowledge that the purpose of learning is the purification of the soul, not simply the establishment of institutions, as Al-Allaamah Siddeeq Hasan Khan [may Allah have mercy upon him] stated, “The scholars unveiled what the drive behind this was and they spoke about it when the building of schools reached them at Baghdad, so they held gatherings of knowledge and said, ‘The possessors of lofty ambitions and the pure souls used to pre-occupy themselves with it (i.e. knowledge) – those whose intention behind knowledge was due to its nobility and the perfection (reached by way of it), therefore, they came to the scholars to benefit from them and their knowledge'”. Third, there is no doubt that modern university systems are beneficial and in some cases, they make learning easier for those who are blind or affected by severe visual impairment. The anonymous writers at Wikipedia stated that many of ibn Baz’s views and rulings are considered controversial (both inside and outside Saudi Arabia), including Saudi Arabia’s support for the Oslo Accords!

First, Al-Allaamah Saalih Al-Fawzaan [may Allah preserve him] stated regarding interaction with non-Muslims:

[a] Invite them to Islam – the religion Allah has ordained for all of humankind. Allah says:

ٱدۡعُ إِلَىٰ سَبِيلِ رَبِّكَ بِٱلۡحِكۡمَةِ وَٱلۡمَوۡعِظَةِ ٱلۡحَسَنَةِ‌ۖ وَجَـٰدِلۡهُم بِٱلَّتِى هِىَ أَحۡسَنُ‌ۚ

“Invite (mankind, O Muhammad) to the Way of your Lord (i.e. Islam) with wisdom (i.e. with the Divine Inspiration and the Qur’an) and fair preaching, and argue with them in a way that is better”.

Therefore, we invite them (to Islam) for their rectification and happiness in this life and the next.

[b] Make peace with them if they seek it. Allah says:

وَإِن جَنَحُواْ لِلسَّلۡمِ فَٱجۡنَحۡ لَهَا وَتَوَكَّلۡ عَلَى ٱللَّهِ‌ۚ إِنَّهُ ۥ هُوَ ٱلسَّمِيعُ ٱلۡعَلِيمُ

But if they incline to peace, you also incline to it, and (put your) trust in Allah. Verily, He is the All-Hearer, the All-Knower].

Make peace with them if the Muslims are in need of making peace, and when there is an overriding benefit for the Muslims in making peace, just as the Prophet [peace and blessings of Allah be upon him] made peace with the unbelievers at Hudaibiyyah. And by virtue of peace, diplomacy is (established) between them and the Muslims.

[c] Refrain from hostility against them without due right. Allah says:

وَلَا يَجۡرِمَنَّڪُمۡ شَنَـَٔانُ قَوۡمٍ عَلَىٰٓ أَلَّا تَعۡدِلُواْ‌ۚ ٱعۡدِلُواْ هُوَ أَقۡرَبُ لِلتَّقۡوَىٰ‌ۖ وَٱتَّقُواْ ٱللَّهَ‌ۚ إِنَّ ٱللَّهَ خَبِيرُۢ بِمَا تَعۡمَلُونَ

And let not the enmity and hatred of others make you avoid justice. Be just: that is nearer to piety, and fear Allaah].

Behave well towards those of them who behave well towards the Muslims- those who neither kill nor drive Muslims out of their homes. Allah says:

لَّا يَنۡهَٮٰكُمُ ٱللَّهُ عَنِ ٱلَّذِينَ لَمۡ يُقَـٰتِلُوكُمۡ فِى ٱلدِّينِ وَلَمۡ يُخۡرِجُوكُم مِّن دِيَـٰرِكُمۡ أَن تَبَرُّوهُمۡ وَتُقۡسِطُوٓاْ إِلَيۡہِمۡ‌ۚ إِنَّ ٱللَّهَ يُحِبُّ ٱلۡمُقۡسِطِينَ

Allah does not forbid you to deal justly and kindly with those who fought not against you on account of religion and did not drive you out of your homes. Verily, Allah loves those who deal with equity].

[d] Have permissible beneficial dealings with them- in trade, exchange of beneficial information and utilisation of the worldly sciences, and things that are of benefit in our lives.

[e] Fulfil contacts made with them, and honour the blood, wealth and rights of the Mu’aahideen (i.e. those non-Muslims who have a treaty with the Muslims) because it is binding upon them to (fulfil their covenants with the Muslims) and the Muslims are to (fulfil their covenants with them). Allah says:

فَمَا ٱسۡتَقَـٰمُواْ لَكُمۡ فَٱسۡتَقِيمُواْ لَهُمۡ‌ۚ

So long, as they are true to you, stand you true to them].

And the ones forbidden to be killed are the Muslims and the Mu’aahid [i.e. the non-Muslims who have a treaty with the Muslims]. And indeed the Prophet said about the killing of a Mu’aahid, “Whoever kills a Mu’aahid will not even smell the fragrance of paradise and its fragrance can be smelled from the distance of forty years away”. [Bukhaari: No: 3166]

And whoever kills a Mu’aahid by mistake, it is as if he has killed a Muslim by mistake. He must pay blood money as expiation. Allah said:

وَإِن ڪَانَ مِن قَوۡمِۭ بَيۡنَڪُمۡ وَبَيۡنَهُم مِّيثَـٰقٌ۬ فَدِيَةٌ۬ مُّسَلَّمَةٌ إِلَىٰٓ أَهۡلِهِۦ وَتَحۡرِيرُ رَقَبَةٍ۬ مُّؤۡمِنَةٍ۬‌ۖ

And if he belonged to a people with whom you have a treaty of mutual alliance, compensation (blood money – Diya) must be paid to his family, and a believing slave must be freed]. [(2)]

Response: Militant Secularists, modernists, and proponents of immorality continue to argue that segregating the two biological sexes in the arena of work is unprogressive. The Salafi Scholars, in particular Imaam Abdul Azeez Bin Baaz [may Allah have mercy upon him], have responded to this viewpoint of theirs, which is solely motivated by a desire to either reject the infallible divine revelation or pursue so-called equality and progress at the expense of sound morality. When asked if a woman is considered to be pursuing her whims and desires if she works without a need for money, the Imaam responded: “Her engagement in work is not tantamount to following desires if it is a noble and safe occupation, and carried out amongst women, without free mixing with men, and she only works amongst women without any injustice and hostility, with the permission of her husband. There are different types of work, and if the work includes disobedience to Allah, then it is obligatory for her to abandon it. If it includes free mixing between men and women and showing her beauty, then this is also evil. But if it is work that is allowed or legislated by Islamic law amongst her Muslim sisters, such as teaching girls, or working as a nurse, or working as a doctor for women, then there is no harm in this and all praise is due to Allah. Allah [The Exalted] says:

أَلَمْ تَرَ إِلَى الَّذِي حَاجَّ إِبْرَاهِيمَ فِي رَبِّهِ أَنْ آتَاهُ اللَّهُ الْمُلْكَ إِذْ قَالَ إِبْرَاهِيمُ رَبِّيَ الَّذِي يُحْيِي وَيُمِيتُ قَالَ أَنَا أُحْيِي وَأُمِيتُ ۖ قَالَ إِبْرَاهِيمُ فَإِنَّ اللَّهَ يَأْتِي بِالشَّمْسِ مِنَ الْمَشْرِقِ فَأْتِ بِهَا مِنَ الْمَغْرِبِ فَبُهِتَ الَّذِي كَفَرَ ۗ وَاللَّهُ لَا يَهْدِي الْقَوْمَ الظَّالِمِينَ

Have you not seen (contemplated with your heart) him who disputed with Ibrahim (Abraham) about his Lord (Allah), because Allah had given him the kingdom? When Ibrahim (Abraham) said (to him): “My Lord (Allah) is He Who gives life and causes death.” He said, “I give life and cause death.” Ibrahim (Abraham) said, “Verily! Allah causes the sun to rise from the east; then cause it you to rise from the west.” So the disbeliever was utterly defeated. And Allah guides not the people, who are Zalimun (wrong-doers, etc.). [Surah Al-Baqarah. Ayah 258]

Imam Al-Baghawi [may Allah have mercy upon him] stated that there is a difference of opinion among Qur’an commentators regarding the timing of this debate. Muqatil [may Allah have mercy upon him] mentioned that when Ibraahim [peace be upon him] destroyed the idols, Namrood imprisoned him and later attempted to burn him with fire. Namrood asked Ibraaheem [peace be upon him], “Who is your Lord that you call us to worship?” Ibraaheem [peace be upon him] replied, “My Lord is the one who gives life and causes death.” Other commentators suggest that this incident occurred after Ibraaheem [peace be upon him] was thrown into the fire. Subsequently, people suffered from drought and would seek food from Namrood. When a man approached Namrood for food, he would inquire, “Who is your Lord?” If the man responded, “You are my Lord,” Namrood would agree to sell him food. [1]

[أَلَمۡ تَرَ إِلَى ٱلَّذِى حَآجَّ إِبۡرَٲهِـۧمَ فِى رَبِّهِۦۤ – Have you seen (contemplated with your heart and eyes) him who disputed with Ibrahim (Abraham) about his Lord (Allah)]- Meaning, his impudence, ignorance, and obstinacy, along with his incessant arguments on matters that are unquestionable?! His behaviour can only be attributed to the fact that “Allah had bestowed upon him the kingdom,” thus he exceeded his limits, rebelled, and even went as far as challenging Prophet Ibraaheem on Allah’s sovereignty, arrogantly claiming that he possessed the same power as Allah.

Prophet Ibraheem said to him, “My Lord is He Who gives life and death” – Meaning, Allah is the sole authority over everything, then Ibraaheem specifically mentioned two significant matters – life and death – as they hold the utmost importance in Allah’s complete control. This is because the bestowal of life marks the commencement of worldly existence, while death signifies the beginning of what awaits in the afterlife. Hence, the individual who attempted to dispute Ibraaheem’s statement asserted, “I possess the ability to grant life and cause death,” but never proclaimed, “I am The One Who grants life and death.” This is because he could not assert that he did not require any external intervention in these matters. Instead, he merely claimed that he could replicate what Allah does by taking someone’s life or sparing it.

Prophet Ibraaheem recognised the flaw in his opponent’s argument and the statement he uttered, which is not even worthy of being a doubt let alone proof. Ibraaheem then responded by stating, “Indeed, Allah causes the sun to rise from the east.” This statement was something that could be observed and confirmed by everyone, including the disbeliever. Ibraaheem further challenged him by saying, “Then cause it to rise from the west.” This compelled the disbeliever to provide evidence if he truly believed in his claim. However, the disbeliever was unable to present any ambiguity to undermine Ibraaheem’s proof or find any fault with it. As a result, he was completely defeated, unable to respond, and his argument crumbled. [2] The One who has power over life and death (Allah) possesses complete authority over all creation, bringing forth everything within it, including full control over the planets and their orbits. As the sun consistently rises in the east each day, if you truly were a deity who grants life and administers death, then command the sun to rise from the west. [3]

This describes a stubborn liar who seeks to challenge the truth and emerge victorious, as he will ultimately be vanquished and humbled. This is why Allah says: [وَٱللَّهُ لَا يَہۡدِى ٱلۡقَوۡمَ ٱلظَّـٰلِمِينَ – And Allah guides not the people, who are Zalimun (wrong-doers, etc.)]; rather He abandons them to their disbelief and misguidance. [4]

 

The Quraish Starved The Prophet and His Near Relatives

Abu Hurairah [may Allah be pleased with him] reported: On the Day of Nahr at Mina, the Prophet [peace and blessings of Allaah be upon him] said, “Tomorrow we shall stay at Khaif Bani Kinana where the pagans had taken the oath of disbelief”. He meant (by that place) Al-Muhassab where the Quraish tribe and Banu Kinaanah concluded a contract against Banu Haashim and Banu Abdul-Muttalib or Banu Al-Muttalib that they would not intermarry with them or deal with them in business until they handed over the Prophet to them. [5]

Usaamah Bin Zayd [may Allah be pleased with him] said: I asked the Prophet [peace and blessings of Allah be upon him] during his Hajj, “O Allah’s Messenger! Where will you stay tomorrow?” He said, “Has Aqeel left for us any house?” He then added, “Tomorrow we will stay at Khaif Bani Kinana, i.e. Al-Muhassab, where Quraish (polytheists) took an oath of disbelief in that Banu Kinaanah allied with Quraish against Banu Hashim on the terms that they would not deal with the members of the tribe or give them shelter”. [6]

The incident mentioned in the above narrations took place when the Makkan polytheists had a meeting at a place called the Valley of Al-Muhassab, where they established an alliance against Banu Haashim and Banu Al-Muttalib. They agreed not to have any business transactions with them, no marriage ties, no visits, and no verbal communication with the Prophet [peace and blessings of Allaah be upon him] and those who aided him. So, Abu Taalib – the Prophet’s uncle who stood by him at the time – decided to move to a valley in the eastern suburbs of Makkah, then Banu Haashim and Banu Al-Muttalib also moved and they were all confined to a narrow passage. They remained in that situation for three years- from the 7th year of the Prophet’s Prophethood until the 10th year. It was a very repressive embargo that brought extreme hardship, and in addition to this, the vile polytheists bought everything that reached Makkah so that nothing reached Banu Al-Mutallib and Banu Haashim. The situation became so bad that they had to eat the leaves of trees and animal skins, and children constantly cried due to hunger. They had nothing besides very little provision that was sometimes delivered secretly by some people in Makkah who sympathised with them. During the sacred months when fighting was not permitted, they used to go and buy provisions, but the prices of goods were inflated so that they would not be able to afford them. However, this great hardship never stopped the Prophet [peace and blessings of Allaah be upon him] from calling to the truth, rather he used to go to the Ka‘bah and call people to Islam. By the grace of Allah, the agreement between the polytheists ended in the 10th year of the Prophet’s Prophethood because some of them could no longer bear to see their relatives in that situation. [7]

 

The Excellent Character of The Prophet When Allah Gave Him The Upper Hand

Abu Hurairah [may Allah be pleased with him] reported: “The Prophet sent a troop of fighters towards Najd and they brought a man from the tribe of Banu Haneefah who was called Thumamah bin Uthaal. He was then tied to one of the pillars of the Masjid. The Prophet went to him and said, “What have you got, O Thumama?” He replied, “I have got a good thought, O Muhammad! If you should kill me, you would kill a person who has already killed somebody, and if you should set me free, you would do a favor to one who is grateful, and if you want property, then ask me whatever wealth you want.” So, he was left till the next day when again the Prophet (ﷺ) said to him, “What have you got, O Thumama?” He said, “What I have already told you”. The Prophet (ﷺ) left him till the day after, and said to him again, “What have you got, O Thumama?” He said, “I have got what I told you. So the Prophet (ﷺ) said, “Set him free”. Then Thumamah) went to a garden of date palm trees near the Masjid, took a bath, entered the Masjid, and then said, “I testify that None has the right to be worshipped except Allah, and also testify that Muhammad is His Messenger! By Allah, O Muhammad! There was no face on the surface of the earth most disliked by me than yours, but now your face has become the most beloved face to me. By Allah, there was no religion more disliked by me than yours, but now it is the most beloved religion to me. By Allah, there was no town more disliked by me than your town, but now it is the most beloved town to me. Your troops arrested me (at the time) when I was intending to perform the `Umra. And now what do you think?” The Prophet (ﷺ) gave him good tidings of good in this world and the next, and ordered him to perform the `Umra. So when he came to Makkah, someone said to him, “You have become a Sabian?” He replied, “No! By Allah, I have submitted to Islam with Muhammad, Allaah’s Messenger. No, by Allah! Not a single grain of wheat will come to you from Yamamah unless the Prophet gives his permission”. [8]

The Prophet asked Thumaamah, “What have you got O Thumaamah?” He replied that he has good thoughts about the Prophet- Meaning, “You O Muhammad never oppress anyone, rather you are from those who pardon and do good”. So after he was set free, he entered Makkah to perform Umrah and then pronounced the Talbilya and was the first to enter Makkah in that manner, so Quraish grabbed him and said, “You dare to do this to us”, and they wanted to kill him; then a person amongst the Quraish said, “Leave him because you need food from Yamaamah (i.e. from his land)”, so they released him. Then he said to them, “By Allah! Not a single grain of wheat will come to you from Yamamah unless the Prophet gives his permission.” Ibn Hishaam said, “Then Thumaamah returned to Yamaamah and prevented the Quraish from bringing any food to Makkah, so the Quraish wrote to the Prophet saying, “Indeed, you command people to keep good the ties of kinship”, so the Prophet wrote to Thumaamah to allow them to transport their food”.

 

This hadeeth provides the following benefits:

[I] It is permissible for the Muslim ruler to imprison an unbeliever prisoner of war in the Masjid due to some benefit; the permissibility of allowing an unbeliever in the Masjid to drink water and listen to lectures.

[II] To treat a non-Muslim prisoner of war kindly. Even though Thumaamah was an arch-enemy, he was forgiven, and this shows the great virtue of forgiveness. When the Prophet saw that Thumaamaah was constantly having good thoughts, he pardoned him and this was a pardon in its right place and perfect circumstances. This also shows that the Muslim ruler can pardon a non-Muslim prisoner of war due to an overriding benefit or execute him based on an overriding benefit.

[III] In this hadeeth, we also learn that one should closely watch those prisoners of war who desire to accept Islam, especially those amongst them who – when they accept Islam, others will follow them. [9]

 

True Believers’ Attitude Towards Feeding Those in Need, Including Captured Combatants

Allah [The Exalted] informs us of some of the qualities of the Abraar [The pious, who fear Allah and avoid evil]: ويُطۡعِمُونَ ٱلطَّعَامَ عَلَىٰ حُبِّهِۦ – And they give food, despite their love for it]- Meaning, they are in a state in which they love wealth and food, but they give precedence to the love of Allah over the what their souls love and seek to feed the people who deserve and need it the most; [مِسۡكِينً۬ا وَيَتِيمً۬ا وَأَسِيرًا – the Miskin (poor), the orphan, and the captive (10)]; saying, [إِنَّمَا نُطۡعِمُكُمۡ لِوَجۡهِ ٱللَّهِ -We feed you seeking Allah’s Countenance only. We wish for no reward, nor thanks from you] – Meaning, to seek Allah’s Reward. Mujaahid and Ibn Jubayr [may Allah have mercy upon them] said, “As for these people, they did not utter this statement, but Allah knows this is what is in their hearts, so He praised them for it as an exhortation for the one who desires to do so”. [لَا نُرِيدُ مِنكُمۡ جَزَآءً۬ – We wish for no reward]- Meaning, by way of actions; [وَلَا شُكُورًا – nor thanks]- Meaning, by way of statement. [11]
[إِنَّا نَخَافُ مِن رَّبِّنَا يَوۡمًا عَبُوسً۬ا قَمۡطَرِيرً۬ا – Verily, We fear from our Lord a Day, hard and distressful, that will make the faces look horrible (from extreme dislikeness to it)].

[فَوَقَٮٰهُمُ ٱللَّهُ شَرَّ ذَٲلِكَ ٱلۡيَوۡمِ وَلَقَّٮٰهُمۡ نَضۡرَةً۬ وَسُرُورً۬ا – So Allah saved them from the evil of that Day, and gave them Nadratan (a light of beauty) and joy]. [Surah Al-Insaan. Ayaat 8-11]

Indeed, the path of Allaah Messenger [peace and blessings of Allaah be upon him] is the only perfect path to follow in all affairs. We’ve witnessed and heard – in our era – the brutal manner in which Netanyahu’s Zionist Far-right regime continues to murder, starve, and brutalise Palestinians with impunity. O Allah! Send the obstinate disbeliever Netanyahu and his henchmen your swift justice from above, below, on their right, left, in front, and behind; and grant our Palestinian brothers and sisters complete relief that leaves no trace of this painful affliction Aameen.

Truly, the guidance of Allah’s Messenger [peace and blessings be upon him] is the sole flawless path to adhere to in every aspect. In our present time, we have witnessed and heard of the merciless methods employed by Netanyahu’s Zionist Far-right government, which persistently inflicts violence, starvation, and oppression upon the Palestinians without facing any consequences. O Allah! May you swiftly administer your divine justice upon the stubborn disbeliever Netanyahu and his accomplices, from every direction – above, below, right, left, in front, and behind. Grant our Palestinian brothers and sisters complete relief, eradicating every trace of this agonising affliction. Aameen. Nevertheless, we do not condone any acts of violence towards civilians and non-combatants by individuals who identify as Muslim, regardless of their beliefs or race.

In The Name of Allah, The Most Merciful, The Bestower of Mercy.

The Prophet [peace and blessings of Allah be upon him] said, “Indeed, the scholars are the inheritors of the prophets, for the prophets do not leave behind a dinar or a dirham for inheritance, but rather, they leave behind knowledge. So whoever takes hold of it, has acquired a large share (i.e. of inheritance)”. [Sunan At-Tirmidhee 2682]

The anonymous writers at Wikipedia stated that among the controversial views and rulings of Imam Abdul Azeez Bin Baaz [may Allah have mercy upon him] is the subject matter of women’s rights!

Response: Secularists, modernists, and proponents of immorality continue to argue that segregating the two biological sexes in the realm of education is unprogressive. The Salafi Scholars, in particular Imaam Abdul Azeez Bin Baaz [may Allah have mercy upon him], have responded to this viewpoint of theirs, which is solely motivated by a desire to either reject the infallible divine revelation or pursue so-called equality and progress at the expense of sound morality. One of the proponents of this corruption was refuted by the Imaam as follows:

All praise and thanks belong to Allah, and peace and blessings be upon the Messenger, his family, and companions. To proceed: I have seen what was published by As-Siyaasah newspaper- issued on 7/24/1404 AH, Number 5644 – and attributed to the Dean of Sana’a University Abdul Azeez Al-Maqaaleh, in which he claimed that the demand to isolate female students from male students is in opposition to the Shariah, and he utilized as proof – for the permissibility of mixing – that Muslims – from the time of the Messenger [peace and blessings of Allah be upon him]- used to pray in the same mosque- men and women- and he said, “Therefore, education must be in one place”.

I (i.e. Abdul Azeez Bin Baaz) was surprised to hear this speech from a Dean of an Islamic university in an Islamic country and asked him to direct his people – men and women – to what will bring about happiness and salvation in this worldly life and the Hereafter. There is no doubt that there is in this speech that which is tantamount to a great crime against the Islamic Shariah because indeed the Shariah did not call for free mixing, such that the demand to prevent it would be in opposition to it; rather it forbids it and did so in a very strong manner, just as Allah [The Exalted] says:

[وَقَرْنَ فِي بُيُوتِكُنَّ وَلا تَبَرَّجْنَ تَبَرُّجَ الْجَاهِلِيَّةِ الْأُولَى – And stay in your houses, and do not display yourselves like that of the times of ignorance]. [Surah Al-Ahzaab. Verse 33]

Allah [The Exalted] says:

يَا أَيُّهَا النَّبِيُّ قُلْْ لِأَزْوَاجِكَ وَبَنَاتِكَ وَنِسَاءِ الْمُؤْمِنِينَ يُدْنِينَ عَلَيْهِنَّ مِنْ جَلابِيبِهِنَّ ذَلِكَ أَدْنَى أَنْ يُعْرَفْنَ فلا يؤذين وكان اللهه غفورا رحيما

O Prophet! Tell your wives and your daughters and the women of the believers to draw their cloaks (veils) all over their bodies (i.e.screen themselves completely except the eyes or one eye to see the way). That will be better, that they should be known (as free respectable women) so as not to be annoyed. And Allah is Ever Oft-Forgiving, Most Merciful. [Surah Al-Ahzaab. Verse 59]

Allah [Glorified be He and free is He from all imperfections] says:

وَقُلْ لِلْمُؤْمِنَاتِ يَغْضُضْنَ مِنْ أَبْصَارِهِنَّ وَيَحْفَظْنََ فُرُوجَهُنَّ وَلا يُبْدِينَ زِينَتَهُنَّ إِلا مَا ظَهَرَ مِنْهَا وَلْيَضْرِبْنَ بِخُمُرِهِنَّ عَلَى جُيُوبِهِنَّ وَلا يُبْدِينَ زِينَتَهُنَّ إِلاا لِبُعُولَتِهِنَّ أَوْ آبَائِهِنَّ أَوْ آبَاءِ بُعُولَتِهِنَّ أَوْ أَبْنَائِهِنَّ أَوْ أَبْنَاءِ بُعُولَتِهِنَّ أَوْ إِخْوَانِهِنَّ أَوْ بَنِي إِخْوَانِهِنَّ أَوْ بَنِي أَخَوَاتِهِنَّ أَوْ نِسَائِهِنَّ أَوْ مَا مَلَكَتْ أَيْمَانُهُنَّ

And tell the believing women to lower their gaze (from looking at forbidden things), and protect their private parts (from illegal sexual acts, etc.) and not to show off their adornment except only that which is apparent (like palms of hands or both eyes for necessity to see the way, or outer dress like veil, gloves, head-cover, apron, etc.), and to draw their veils all over Juyubihinna (i.e. their bodies, necks and bosoms, etc.) and not to reveal their adornment except to their husbands, their fathers, their husband’s fathers, their sons, their husband’s sons, their brothers or their brother’s sons, or their sister’s sons, or their (Muslim) women (i.e. their sisters in Islam), or the (female) slaves whom their right hands possess.

وَلا يَضْرِبْنَ بِأَرْجُلِهِنَّ لِيُعْلَمَ مَا يُخْفِينََ مِنْ زِينَتِهِنَّ وَتُوبُوا إِلَى اللَّهِ جَمِيعًا أَيُّهَا الْمُؤْمِنُونَ لَعَلَّكُمْ تُفْلِحُونَ

And let them not stamp their feet so as to reveal what they hide of their adornment. And all of you beg Allah to forgive you all, O believers, that you may be successful. [Surah An-Nur. Verse 31]

Allah [The Exalted] says:

وَإِذَا سَأَلْتُمُوهُنَّ مَتَاعًا فَاسْأَلُوهُنَّ مِنْ وَرَاءِ حِجَابٍ ذَلِكُمْ أَطْهَرُ لِقُلُوبِكُمْ وَقُلُوبِهِنَّ

And when you ask (the Prophet’s wives) for anything you want, ask them from behind a screen, that is purer for your hearts and for their hearts]. [Surah Al-Ahzaab. Verse 53]

In these noble verses, there is a clear indication that it is legislated for women to stay in their homes to guard against temptation, and that they only come out of their homes if there is a need. Then Allaah [Glory be to He and free is He from all imperfections] warned them that they should not display themselves in a manner similar to the era of pre-islamic ignorance, which is the display of their beauty and cause temptation among men. It has been authentically reported from Allaah’s Messenger [peace and blessings of Allaah be upon him] that he said, “I have not left after me a trial more harmful to men than women”. This hadeeth is agreed upon (i.e. recorded by Al-Bukhaari and Muslim) and it was narrated by Usamah Bin Zayd [may Allah be pleased with him].

Imam Muslim recorded in Saheeh Muslim on the authority of Usaamah and Sa’eed Bin Zayd Bin Amr Bin Nufayl [may Allaah be pleased with them both], and also in Saheeh Muslim on the authority of Abu Saeed Al-Khudri [may Allaah be pleased with him] from the Prophet [peace and blessings of Allaah be upon him] that he said, “Verily the worldly life is sweet and green, and verily Allaah is going to place you as successors upon it in and will see how you act. So, be mindful of the worldly life and be mindful of women, because indeed the first trial for the Children of Israa’eel was due to women”. [Saheeh Muslim. 2742]

And indeed Allah’s Messenger [peace and blessings of Allaah be upon him] spoke the truth because the temptation by way of women is great, especially in this era in which most of them do not have the Hijaab and they display themslves in a manner similar to the era of pre-Islamic ignorance. Immorality and evil has become rife due to this, and many youth (male and female)- in many countries- became reluctant to get married based on that which Allah has legislated. Indeed, Allah has made it clear that the Hijaab is purer for the hearts of everyone and this shows that its removal is most likely to defile the hearts (i.e. corrupt the hearts) of everyone and deviating them from the path of truth. It is known that the female student sitting with the male student is one of the greatest causes of temptation, one of the reasons for abandoning the Hijaab that is legislated by Allah for believing women and forbade them from showing their adornment others (i.e. non-Mahrams), which Allah [Glorified be He and free is He from all imperfections] made known in the previous verse of Surah An-Nur. Whoever claims that the command regarding Hijaab is only for the mothers of the believers is mistaken and far removed from what is correct – contradicted the many evidences pointing to a generalization and contradicted Allah’s statement:

[ذَلِكُمْ أَطْهَرُ لِقُلُوبِكُمْ وَقُلُوبِهِنَّ – that is purer for your hearts and for their hearts], because indeed it is not permissible to say that the Hijaab is purer for the hearts of the mothers of the believers and the male Companions and not for those after them. There is no doubt that those who came after the mothers of the believers and the male companions [may Allah be pleased with them] are more in need of Hijaab, because of the great difference between them in the strength of faith and insight with regards to acquaintance with truth. That is because the Companions [may Allah be pleased with them] – men and women, including the mothers of the believers- are the best of people after the Prophets [peace be upon them] and the best of generations established by the Messenger’s [peace and blessings be upon him] statement in the hadeeth recorded in the Saheehayn [Al-Bukhaari and Muslim]. Therefore, when it is the case that Hijaab is purer for their hearts, then those who came after them have a far greater need of this purity.

It is not permissible to specify the texts of the Qur’an and the Sunnah to anyone in the ummah without valid evidence that shows this specification; therefore, they are generally applied to all the Ummah during the era of the Messenger [peace be upon him] and after him until the Day of Resurrection because Allah [Glorified be He and free is He from all imperfections] sent His Messenger [peace and blessings be upon him] to humankind and Jinn during his era and after him until the Day of Resurrection, as Allah [The Mighty and Majestic] says:

[وَمَآ أَرۡسَلۡنَـٰكَ إِلَّا ڪَآفَّةً۬ لِّلنَّاسِ بَشِيرً۬ا وَنَذِيرً۬ا – And We have not sent you (O Muhammad) except as a giver of glad tidings and a warner to all humankind]. [Surah Saba. Verse 28]

The Noble Qur’an was not only revealed to the people of the Prophet’s era [may peace and blessings of Allah be upon him], rather it was also revealed to those after them, as Allah [The Exalted] said: “This (Qur’an) is a Message for humankind (and a clear proof against them), in order that they may be warned thereby, and that they may know that He is the only One Ilah (God – Allah) – (none has the right to be worshipped but Allah), and that men of understanding may take heed]”. [Surah Ibraaheem. Verse 52]

Allah [The Exalted] says:

[ وَأُوحِيَ إِلَيَّ هَذَا الْقُرْآنُ لِأُنْذِرَكُمْ بِهِ وَمَنْ بَلَغَ – this Qur’an has been revealed to me that I may therewith warn you and whomsoever it may reach]. [Surah Al-An’aam. Verse 19]

In the era of the Prophet [peace and blessings of Allaah be upon him], women did not intermingle with men- neither in mosques nor in the markets – (in the manner people intermingle nowadays), which the callers to rectification forbid in this era- (the type intermingling which) the Qur’an, the Sunnah and the scholars of the Ummah warn against in order to caution against temptation; rather, women – in the Prophet’s mosque – prayed behind the men in the last rows- away from the men. The Prophet used yo say, “The best rows for the men are the first ones and the worst are the last ones. The best of the women’s rows are the last ones and the worst of them is the first”. During the era of the Prophet, the men were commanded to wait until the women left the mosque so that the men would not mingle with them at the doors of the mosques, despite the faith and piety they had; so how about those after them?! Women were forbidden from walking in the middle of the road in order to be careful of having contact with men and thus temptation occurs through touching each other when walking on the road. Allah [Glorified be to He and free is He from all imperfections] commanded the women of the believers to draw their cloaks all over their bodies so that they cover their adornment with it, in order to prevent temptation. Allah forbade them from showing their adornment to other than those mentioned by Allah in His Mighty Book in order to curtail the causes of temptation, urge towards chastity, distance from corruption and (the evil effects) of free mixing.

So, how can the Dean of Sana’a University – [may Allah guide and inspire him to His guidance] – after all this call for mixing?! He claims that Islam calls to it- that the university campus is like a mosque and the hours of study are like the hours of prayer! For the one who understands Allaah’s command and prohibition, knows Allaah’s wisdom in what He has legislated for His servants and explained in His Great Book with regards to rulings for men and women, it is well-known that there is a great difference between these affairs and the difference is vast. How is it permissible for a believer to say that a female student sitting with a male student is like sitting with her sisters in their rows behind the men (in the Masjid)?! No one with the least handhold of faith and insight (in this affair) would say this. We might not even be safe together with the presence of the legislated Hijaab (except by the help of Allaah), so how about if she is sitting with the male student whilst dressed in an un-Islamic manner, displaying her beauty and attractive looks, and with speech that will lead to temptation? Allaah’s Aid is sought, and there is no power nor might except with Allaah. Allaah [The Mighty and Majestic] says:

فَإِنَّهَا لا تَعْمَى الْأَبْصَارُ وَلَكِنْ تَعْمَى الْقُلُوبُ الَّتِي فِي الصُّدُورِ

Verily, it is not the eyes that grow blind, but it is the hearts which are in the breasts that grow blind]. [Surah Al-Hajj. Verse 46]

As for his statement: “Indeed, since the time of the Messenger, Muslims have been performing prayer in the same mosque, men and women, and therefore education must be in one place)”; the answer to this is: this is true, but the women were at the back of the mosques with Hijaab – with care and being careful of what would cause temptation, and the men were at the front of the mosque. They [i.e. the women] used to listen to admonitions and sermons, participated in prayer and learned the rulings of their religion from what they heard and witnessed. The Prophet [peace and blessings of Allaah be upon him] used to go to them on the day of Eid – because they were at a distance and could not hear the sermon – after delivering admonition to the men and gave them an admonition and reminder. There is no problem in all of this, but the problem is in the statements of the Dean of Sana’a University [may Allaah guide him, reform his heart, and give him understanding of his religion]. How is it permissible for him to compare education in our time with women praying behind men in one mosque, although there is a vast difference between the reality of education that is known today and the reality of women praying behind men in the Prophet’s era?! And due to this reason, the callers to rectification call for the separation of women and men in the arena of education- women in a separate place and the young men in another, so that a female can acquire knowledge from female teachers with comfort without Hijaab or hardship, because the time period for education is longer than the time period of prayer. And due to the fact that learning from female teachers in a specific place (i.e. away from men) protects everyone and keeps them away from the causes of temptation, and it is the safest thing for young men not to get tempted through women. And because young men being alone and separated from girls, together with the fact that it is the safest thing for them against temptation, is most likely to make them pay attention to their lessons and occupy themselves with it- listening well to teachers and receiving knowledge from the teachers whilst distanced from paying attention to girls, being preoccupied with them, exchanging glances that will intoxicate the hearts and mind with evil desires and statements that leads to immorality.

As for his claim [may Allah rectify him] that the call to isolate female students from male students is tantamount to rigidity and an opposition to the Shariah, this is an untrue claim; rather separating male students from female students is an act of sincere devotion to Allah, sincere advice to Allah’s servants, taking good care of the religion ordained by Allah and adherence to what has already been transmitted from noble verses of the Qur’an and the two Prophetic reports. My advice to the Dean of Sana’a University is to fear Allah [The Mighty and Majestic], repent to Allah for what he has done, return to the truth and what is correct, because indeed returning to (truth and what is correct) is virtue itself and a proof regarding the search for truth and equity by the student of knowledge.

And Allah is the One asked to guide all of us to the path of righteousness, protect us and other Muslims from speaking about Him without knowledge , (protect us) from the misleading trials and Satan’s enmity, just as we ask Allah to grant success to the scholars of the Muslims and their leaders – in every place – to that which contains rectification (uprightness, wellbeing) for the country and the servants, in the life and the next; and to guide everyone to the straight path, for Allah is Jawwaadun Kareem [Al-Jawwaad – The Munificent. The One Whose generosity covers everything in existence. The One Who gives liberally and generously to those in need – even when they reject and disbelieve in Him. The One Who – from His generosity – has prepared in Paradise for His believing servants that which no eye has ever seen, no ear has ever heard of, and which has never been imagined by anyone]; Al-Kareem [The Bountiful, The Generous One. Abundant in good. The One Who causes and makes easy every good. And Who bestows generously. The One so generous that He even bestows favours upon those who reject His favours, and use them as a means to disobey Him]. And may Allah’s peace and blessings be upon our Prophet Muhammad, his family, his companions and all those who follow them in righteousness until the Day of judgment. [(1)]

Imam Ibn Al-Qayyim [may Allah have mercy upon him] said, “There is no doubt that enabling women to free mix with men is the root of every calamity and evil. It is one of the major causes of sweeping divine punishment as well as one of the cause of corruption of the general and specific affairs. Free mixing between men and women is a cause of many immoralities and adultery, and it is one of the causes of widespread death and continuous plagues. When the prostitutes mixed with Musa’s [peace be upon him] army and immorality spread among them, Allah sent a plague on them, and seventy thousand died in one day. The story is well-known in the books of Tafseer. One of the greatest causes of sweeping death is when adultery becomes rife, women are able to free mix with men and walk among them whilst dressed in an un-Islamic manner and beautified. If those in authority knew what is accompanied by this affair of corruption of the worldly affairs and the people – even before corruption in the religion, then indeed it would have been one the things they would more robustly seek to prevent. حكم الاختلاط في التعليم
الحمد لله، والصلاة والسلام على رسول الله وعلى آله وصحبه، أما بعد:
فقد اطلعت على ما نشرته جريدة السياسة الصادرة يوم 24 / 7 / 1404 هـ بعددها 5644 منسوبا إلى مدير جامعة صنعاء عبدالعزيز المقالح، الذي زعم فيه أن المطالبة بعزل الطالبات عن الطلاب مخالفة للشريعة، وقد استدل على جواز الاختلاط بأن المسلمين من عهد الرسول ﷺ كانوا يؤدون الصلاة في مسجد واحد، الرجل والمرأة، وقال: (ولذلك فإن التعليم لا بد أن يكون في مكان واحد).
وقد استغربت صدور هذا الكلام من مدير لجامعة إسلامية في بلد إسلامي، يطلب منه أن يوجه شعبه من الرجال والنساء إلى ما فيه السعادة والنجاة في الدنيا والآخرة، فإنا لله وإنا إليه راجعون، ولا حول ولا قوة إلا بالله.
ولا شك أن هذا الكلام فيه جناية عظيمة على الشريعة الإسلامية؛ لأن الشريعة لم تدع إلى الاختلاط حتى تكون المطالبة بمنعه مخالفة لها، بل هي تمنعه وتشدد في ذلك كما قال الله تعالى: وَقَرْنَ فِي بُيُوتِكُنَّ وَلا تَبَرَّجْنَ تَبَرُّجَ الْجَاهِلِيَّةِ الْأُولَى الآية [الأحزاب:33].
وقال تعالى: يَا أَيُّهَا النَّبِيُّ قُلْْ لِأَزْوَاجِكَ وَبَنَاتِكَ وَنِسَاءِ الْمُؤْمِنِينَ يُدْنِينَ عَلَيْهِنَّ مِنْ جَلابِيبِهِنَّ ذَلِكَ أَدْنَى أَنْ يُعْرَفْنَ فلا يؤذين وكان اللهه غفورا رحيما [الأحزاب:59].
وقال سبحانه: وَقُلْ لِلْمُؤْمِنَاتِ يَغْضُضْنَ مِنْ أَبْصَارِهِنَّ وَيَحْفَظْنََ فُرُوجَهُنَّ وَلا يُبْدِينَ زِينَتَهُنَّ إِلا مَا ظَهَرَ مِنْهَا وَلْيَضْرِبْنَ بِخُمُرِهِنَّ عَلَى جُيُوبِهِنَّ وَلا يُبْدِينَ زِينَتَهُنَّ إِلاا لِبُعُولَتِهِنَّ أَوْ آبَائِهِنَّ أَوْ آبَاءِ بُعُولَتِهِنَّ أَوْ أَبْنَائِهِنَّ أَوْ أَبْنَاءِ بُعُولَتِهِنَّ أَوْ إِخْوَانِهِنَّ أَوْ بَنِي إِخْوَانِهِنَّ أَوْ بَنِي أَخَوَاتِهِنَّ أَوْ نِسَائِهِنَّ أَوْ مَا مَلَكَتْ أَيْمَانُهُنَّ إلى أن قال سبحانه: وَلا يَضْرِبْنَ بِأَرْجُلِهِنَّ لِيُعْلَمَ مَا يُخْفِينََ مِنْ زِينَتِهِنَّ وَتُوبُوا إِلَى اللَّهِ جَمِيعًا أَيُّهَا الْمُؤْمِنُونَ لَعَلَّكُمْ تُفْلِحُونَ [النور:31] وقال تعالى: وَإِذَا سَأَلْتُمُوهُنَّ مَتَاعًا فَاسْأَلُوهُنَّ مِنْ وَرَاءِ حِجَابٍ ذَلِكُمْ أَطْهَرُ لِقُلُوبِكُمْ وَقُلُوبِهِنَّ الآية [الأحزاب:53]
وفي هذه الآيات الكريمات الدلالة الظاهرة على شرعية لزوم النساء لبيوتهن حذرا من الفتنة بهن، إلا من حاجة تدعو إلى الخروج، ثم حذرهن سبحانه من التبرج تبرج الجاهلية، وهو إظهار محاسنهن ومفاتنهن بين الرجال.
وقد صح عن رسول الله ﷺ أنه قال: ما تركت بعدي فتنة أضر على الرجال من النساء متفق عليه من حديث أسامة بن زيد رضي الله عنه، وخرجه مسلم في صحيحه عن أسامة وسعيد بن زيد بن عمرو بن نفيل -رضي الله عنهما جميعا، وفي صحيح مسلم عن أبي سعيد الخدري -رضي الله عنه- عن النبي ﷺ أنه قال: إن الدنيا حلوة خضرة، وإن الله مستخلفكم فيها فناظر كيف تعملون، فاتقوا الدنيا واتقوا النساء، فإن أول فتنة بني إسرائيل كانت في النساء.
ولقد صدق رسول الله ﷺ، فإن الفتنة بهن عظيمة، ولا سيما في هذا العصر الذي خلع فيه أكثرهن الحجاب، وتبرجن فيه تبرج الجاهلية، وكثرت بسبب ذلك الفواحش والمنكرات، وعزوف الكثير من الشباب والفتيات عما شرع الله من الزواج في كثير من البلاد، وقد بين الله سبحانه أن الحجاب أطهر لقلوب الجميع، فدل ذلك على أن زواله أقرب إلى نجاسة قلوب الجميع وانحرافهم عن طريق الحق.
ومعلوم أن جلوس الطالبة مع الطالب في كرسي الدراسة من أعظم أسباب الفتنة، ومن أسباب ترك الحجاب الذي شرعه الله للمؤمنات ونهاهن عن أن يبدين زينتهن لغير من بينهم الله سبحانه في الآية السابقة من سورة النور.
ومن زعم أن الأمر بالحجاب خاص بأمهات المؤمنين فقد أبعد النجعة، وخالف الأدلة الكثيرة الدالة على التعميم، وخالف قوله تعالى: ذَلِكُمْ أَطْهَرُ لِقُلُوبِكُمْ وَقُلُوبِهِنَّ [الأحزاب:53] فإنه لا يجوز أن يقال إن الحجاب أطهر لقلوب أمهات المؤمنين ورجال الصحابة دون من بعدهم، ولا شك أن من بعدهم أحوج إلى الحجاب من أمهات المؤمنين ورجال الصحابة -رضي الله عنهم لما بينهم من الفرق العظيم في قوة الإيمان والبصيرة بالحق، فإن الصحابة -رضي الله عنهم- رجالا ونساء ومنهن أمهات المؤمنين، هم خير الناس بعد الأنبياء، وأفضل القرون بنص الرسول ﷺ المخرج في الصحيحين، فإذا كان الحجاب أطهر لقلوبهم فمن بعدهم أحوج إلى هذه الطهارة وأشد افتقارا إليها ممن قبلهم؛ ولأن النصوص الواردة في الكتاب والسنة لا يجوز أن يخص بها أحد من الأمة إلا بدليل صحيح يدل على التخصيص، فهي عامة لجميع الأمة في عهده ﷺ وبعده إلي يوم القيامة؛ لأنه سبحانه بعث رسوله ﷺ إلى الثقلين في عصره وبعده إلى يوم القيامة، كما قال عز وجل: قُلْ يَا أَيُّهَا النَّاسُ إِنِّي رَسُولُ اللَّهِ إِلَيْكُمْ جَمِيعًا [الأعراف:158] وقال سبحانه: وَمَا أَرْسَلْنَاكَ إِلا كَافَّةً لِلنَّاسِِ بَشِيرًا وَنَذِيرًا [سبأ:28] وهكذا القرآن الكريم لم ينزل لأهل عصر النبي ﷺ، وإنما أنزل لهم ولمن بعدهم ممن يبلغه كتاب الله كما قال تعالى: هَذَا بَلاغٌ لِلنَّاسِ وَلِيُنْذَرُوا بِهِ وَلِيَعْلَمُوا أَنَّمَا هُوَ إِلَهٌ وَاحِدٌٌ وَلِيَذَّكَّرَ أُولُو الْأَلْبَابِ [إبراهيم:52] وقال عز وجل: وَأُوحِيَ إِلَيَّ هَذَا الْقُرْآنُ لِأُنْذِرَكُمْ بِهِ وَمَنْ بَلَغَ الآية [الأنعام:19].
وكان النساء في عهد النبي ﷺ لا يختلطن بالرجال لا في المساجد ولا في الأسواق الاختلاط الذي ينهي عنه المصلحون اليوم، ويرشد القرآن والسنة وعلماء الأمة إلى التحذير منه حذرا من فتنته، بل كان النساء في مسجده ﷺ يصلين خلف الرجال في صفوف متأخرة عن الرجال وكان يقول ﷺ: خير صفوف الرجال أولها، وشره آخرها، وخير صفوف النساء آخرها، وشرها أولها حذرا من افتتان آخر صفوف الرجال بأول صفوف النساء، وكان الرجال في عهده ﷺ يؤمرون بالتريث في الانصراف حتى يمضي النساء ويخرجن من المسجد لئلا يختلط بهن الرجال في أبواب المساجد، مع ما هم عليه جميعا رجالا ونساء من الإيمان والتقوى، فكيف بحال من بعدهم؟! وكانت النساء ينهين أن يتحققن الطريق ويؤمرن بلزوم حافات الطريق حذرا من الاحتكاك بالرجال والفتنة بمماسة بعضهم بعضا عند السير في الطريق.
وأمر الله سبحانه نساء المؤمنين أن يدنين عليهن من جلابيبهن حتى يغطين بها زينتهن حذرا من الفتنة بهن، ونهاهن سبحانه عن إبداء زينتهن لغير من سمى الله سبحانه في كتابه العظيم؛ حسما لأسباب الفتنة، وترغيبا في أسباب العفة، والبعد عن مظاهر الفساد والاختلاط.
فكيف يسوغ لمدير جامعة صنعاء -هداه الله وألهمه رشده- بعد هذا كله، أن يدعو إلى الاختلاط؟! ويزعم أن الإسلام دعا إليه؟! وأن الحرم الجامعي كالمسجد؟! وأن ساعات الدراسة كساعات الصلاة؟! ومعلوم أن الفرق عظيم والبون شاسع لمن عقل عن الله أمره ونهيه، وعرف حكمته سبحانه في تشريعه لعباده، وما بين في كتابه العظيم من الأحكام في شأن الرجال والنساء، وكيف يجوز لمؤمن أن يقول إن جلوس الطالبة بحذاء الطالب في كرسي الدراسة مثل جلوسها مع أخواتها في صفوفهن خلف الرجال؟! هذا لا يقوله من له أدنى مسكة من إيمان وبصيرة يعقل ما يقول، هذا لو سلمنا وجود الحجاب الشرعي، فكيف إذا كان جلوسها مع الطالب في كرسي الدراسة مع التبرج وإظهار المحاسن والنظرات الفاتنة والأحاديث التي تجر إلى الفتنة، فالله المستعان، ولا حول ولا قوة إلا بالله، قال الله عز وجل: فَإِنَّهَا لا تَعْمَى الْأَبْصَارُ وَلَكِنْ تَعْمَى الْقُلُوبُ الَّتِي فِي الصُّدُورِ [الحج:46].
وأما قوله: (والواقع أن المسلمين منذ عهد الرسول كانوا يؤدون الصلاة في مسجد واحد، الرجل والمرأة، ولذلك فإن التعليم لا بد أن يكون في مكان واحد) فالجواب عن ذلك أن يقال: هذا صحيح، لكن كان النساء في مؤخرة المساجد مع الحجاب والعناية والتحفظ مما يسبب الفتنة، والرجال في مقدم المسجد، فيسمعن المواعظ والخطب ويشاركن في الصلاة ويتعلمن أحكام دينهن مما يسمعن ويشاهدن، وكان النبي ﷺ في يوم العيد يذهب إليهن بعد ما يعظ الرجال فيعظهن ويذكرهن لبعدهن عن سماع خطبته، وهذا كله لا إشكال فيه ولا حرج فيه، وإنما الإشكال في قول مدير جامعة صنعاء- هداه الله وأصلح قلبه وفقهه في دينه: (ولذلك فإن التعليم لا بد أن يكون في مكان واحد) فكيف يجوز له أن يشبه التعليم في عصرنا بصلاة النساء خلف الرجال في مسجد واحد؟! مع أن الفرق شاسع بين واقع التعليم المعروف اليوم، وبين واقع صلاة النساء خلف الرجال في عهده – ﷺ، ولهذا دعا المصلحون إلى إفراد النساء عن الرجال في دور التعليم، وأن يكن على حدة والشباب على حدة، حتى يتمكن من تلقي العلم من المدرسات بكل راحة من غير حجاب ولا مشقة؛ لأن زمن التعليم يطول بخلاف زمن الصلاة؛ ولأن تلقي العلوم من المدرسات في محل خاص أصون للجميع وأبعد لهن من أسباب الفتنة، وأسلم للشباب من الفتنة بهن، ولأن انفراد الشباب في دور التعليم عن الفتيات مع كونه أسلم لهم من الفتنة، فهو أقرب إلى عنايتهم بدروسهم وشغلهم بها، وحسن الاستماع إلى الأساتذة وتلقي العلم عنهم بعيدين عن ملاحظة الفتيات والانشغال بهن، وتبادل النظرات المسمومة والكلمات الداعية إلى الفجور.
وأما زعمه- أصلحه الله- أن الدعوة إلى عزل الطالبات عن الطلبة تزمت ومخالف للشريعة، فهي دعوى غير مسلمة، بل ذلك هو عين النصح لله ولعباده والحيطة لدينه والعمل بما سبق من الآيات القرآنية والحديثين الشريفين، ونصيحتي لمدير جامعة صنعاء أن يتقي الله عز وجل وأن يتوب إليه سبحانه مما صدر منه، وأن يرجع إلى الصواب والحق، فإن الرجوع إلى ذلك هو عين الفضيلة والدليل على تحري طالب العلم للحق والإنصاف.
والله المسئول سبحانه أن يهدينا جميعا سبيل الرشاد، وأن يعيذنا وسائر المسلمين من القول عليه بغير علم، ومن مضلات الفتن ونزغات الشيطان، كما أسأله سبحانه أن يوفق علماء المسلمين وقادتهم في كل مكان لما فيه صلاح البلاد والعباد في المعاش والمعاد، وأن يهدي الجميع صراطه المستقيم، إنه جواد كريم، وصلى الله وسلم على نبينا محمد وآله وصحبه والتابعين لهم بإحسان إلى يوم الدين[1].

In The Name of Allah, The Most Merciful, The Bestower of Mercy.

The Prophet [peace and blessings of Allah be upon him] said, “Indeed, the scholars are the inheritors of the prophets, for the prophets do not leave behind a dinar or a dirham for inheritance, but rather, they leave behind knowledge. So whoever takes hold of it, has acquired a large share (i.e. of inheritance)”. [Sunan At-Tirmidhee 2682]

The anonymous writers at Wikipedia stated that among the controversial views and rulings of Imam Abdul Azeez Bin Baaz [may Allah have mercy upon him] is the subject matter of women’s rights!

Response:

First, we have already stated in this series that simply stating that something is controversial is insufficient; rather, every issue on which people disagree must be referred back to the Qur’an and Sunnah. Allah [The Exalted] says:

يَٰٓأَيُّهَا ٱلَّذِينَ ءَامَنُوٓا۟ أَطِيعُوا۟ ٱللَّهَ وَأَطِيعُوا۟ ٱلرَّسُولَ وَأُو۟لِى ٱلْأَمْرِ مِنكُمْ فَإِن تَنَٰزَعْتُمْ فِى شَىْءٍ فَرُدُّوهُ إِلَى ٱللَّهِ وَٱلرَّسُولِ إِن كُنتُمْ تُؤْمِنُونَ بِٱللَّهِ وَٱلْيَوْمِ ٱلْءَاخِرِ ذَٰلِكَ خَيْرٌ وَأَحْسَنُ تَأْوِيلًا

O you who have believed, obey Allāh and obey the Messenger and those in authority over you. And if you disagree among yourselves over anything then refer it back to Allāh and the Messenger if you truly believe in Allāh and the Last Day. That is better (conduct) and (leads to) the most excellent outcome.h

Allah [The Exalted] says

وَمَا ٱخْتَلَفْتُمْ فِيهِ مِن شَىْءٍ فَحُكْمُهُۥٓ إِلَى ٱللَّهِ ذَٰلِكُمُ ٱللَّهُ رَبِّى عَلَيْهِ تَوَكَّلْتُ وَإِلَيْهِ أُنِيبُ

And in whatsoever you differ, the decision thereof is with Allah (He is the ruling Judge). (And say O Muhammad) Such is Allah, my Lord in Whom I put my trust, and to Him I turn in all of my affairs and in repentance. [Surah Ash-Shuraa. Ayah 10]

Second, Imaam Abdul Azeez Bin Baaz [may Allah have mercy upon him] responded to his critics as follows: Those who say that Islam oppresses women are greatly mistaken because it was Islam that treated her with justice and raised her status. She was oppressed in pre-Islamic times among the Arabs, in Judaism, Christianity, and other false religions. [(1)] It is Islam that raised her, exalted her affair, treated her with justice, and bestowed her rights to her. It made her an honourable mother, an honourable wife, and a daughter shown compassion, cared for her, had wealth spent on her, and was treated with kindness until she can look after herself, or get married.

Islam commanded that wealth be spent on her, and obligated to her father and husband to spend on her and treat her kindly; commanded the Islamic State to treat her with justice, fulfill her rights, prevent aggression against her, and give her the value that whenever she is killed (unlawfully by a man), he is executed (by the State). Whenever she is (deliberately) injured (by someone), her rights are fulfilled accordingly, whether a limb is injured or other than that.

As for Allah’s statement:

الرِّجَالُ قَوَّامُونَ عَلَى النِّسَاءِ بِمَا فَضَّلَ اللَّهُ بَعْضَهُمْ عَلَى بَعْضٍ وَبِمَا أَنفَقُوا مِنْ أَمْوَالِهِمْ

Men are protectors and maintainers of women by (right of) what Allāh has made some of them to excel over others and also by (right of) what they spend from their wealth (upon women). [Surah An-Nisaa. Ayah 34] [(2)]

The matter is clear. Allah [Glorified be He and free is He from all imperfections] made men excel over women because the male is generally stronger in fulfilling rights, Jihad against enemies, stopping injustice, Ihsaan towards children and women (i.e. spending on them etc), protecting them from harm and injustice, and other than this which is known based on the Shariah, innate uncorrupted natural disposition and that which is clearly perceived. That is because – in general- men are stronger and more capable of doing what benefits society than women. In addition, men spend their wealth in marriage by giving dowries, spending on their wives, protecting them from harm, and being kind to them.

Men have great rights in two ways: on the one hand, Allah gave them a status that excels that of women because it is known that men are more complete and capable of everything in general. They are more complete – in general – in their mental strength, in examining the outcomes of affairs and welfare, and because they spend their wealth to seek after wives through dowry and other things. That is why Allah [Glorified be He and free is He from all imperfections] says:

الرِّجَالُ قَوَّامُونَ عَلَى النِّسَاءِ بِمَا فَضَّلَ اللَّهُ بَعْضَهُمْ عَلَى بَعْضٍ وَبِمَا أَنفَقُوا مِنْ أَمْوَالِهِمْ

Men are protecters and maintainers of women by (right of) what Allāh has made some of them to excel over others and also by (right of) what they spend from their wealth (upon women)]. [Surah An-Nisaa. Ayah 34]

(However), this does not mean that every man is better than every woman, but rather this higher level given to men is in general. So, when this affair is looked at in detail, there may be a woman who is better than a man. This is a fact and is known, but in general, the male biological sex is of a higher level (i.e. in some specific things) over the female biological sex. This is known by way of the Shariah, sound reasoning, sound innate natural disposition, and it is known by way of reality and experiences, but there are many women who are better than a man because of their knowledge, religious adherence, steadfastness, and insight. Whoever looks at the characteristics of the female companions of the Prophet and those women who followed them exactly in faith, and the women scholars of this Ummah, he will know that there are good women who are better than many men. The Prophet [peace and blessings be upon him] said, “Many men reached the level of perfection, but no woman reached such a level except Maryam, the daughter of Imran, and Asiyah, the wife of Pharaoh”. [(3)]

The virtue of Fatima -may Allah be pleased with her, daughter of the Prophet, the virtue of Khadijah – may Allah be pleased with her – and Aisha – may Allah be pleased with her – indicates that they have special virtue. These five are the best of women: Maryam Bint Imran, the mother of the Messiah [peace be upon him], Khadijah and Aa’isha, among the mothers of the believers, Fatima, the daughter of the Prophet [peace and blessings be upon him], and Asiyah, the wife of Fir’awn. These five women are the best women, and there are many virtuous women, who possess knowledge, and they are more virtuous than many men. However, Allah’s Wisdom necessitates that men are a level higher in status over women in certain things as well, such as inheritance. A daughter is given half of what a male is given among children, a sister from both parents or father is given half of what a full brother or paternal brother is given, and the wife is given half of what the husband takes. If the husband takes half, she gets a quarter, and if the husband takes a quarter, she gets an eighth, and this is great wisdom, and (explanations, clarifications) that if someone with insight contemplates it, he will know its significance, Allah’s Wisdom in it, and that Allah [Glorified be He and free is He from all imperfections] is the All-Wise, the All-Knowing, so every situation in which a man is given a level above a woman has its pertinence, reasons, and wisdom for whoever ponders and reasons carefully. And Allah is the One Whose Aid is sought. [I] [(4)]

Imam Muhammad Ibn Saalih Al-Uthaymeen [may Allah have mercy upon him] stated one of the underlying reasons behind the different percentages received by males and females from inheritance: “Another wisdom in inheritance distribution, where the male is given a share equal to the share of two females, is because there is wisdom in that due to what is entrusted to a man with regards to financial responsibility. A male has more financial responsibility than a female. It is obligated to him to spend on (dependants), pay the dowry (when getting married), and it is obligated to him to perform Jihaad”. In The Name of Allah, The Most Merciful, The Bestower of Mercy.

The Prophet [peace and blessings of Allah be upon him] said, “Indeed, the scholars are the inheritors of the prophets, for the prophets do not leave behind a dinar or a dirham for inheritance, but rather, they leave behind knowledge. So whoever takes hold of it, has acquired a large share (i.e. of inheritance)”. [(1)]

The anonymous writers at Wikipedia stated, “Many of ibn Baz’s views and rulings are considered controversial (both inside and outside Saudi Arabia), including those relating to cosmology…” [End of quote]

Response

Imam Abdul Azeez Bin Baaz [may Allah have mercy upon him] was asked, “Is the earth spherical or flat?” He responded: According to the scholars, the Earth is spherical. Ibn Hazm and a group of other (scholars) have transmitted that the scholars hold a consensus that it is spherical. Meaning: Some of it is joined together with some and rolled up like a ball. However, Allah spread out the top of it for us and placed on it firm mountains, animals, and seas out of mercy for us. This is why Allah says: [وَإِلَى الأَرْضِ كَيْفَ سُطِحَتْ – And at the earth, how it has been spread out (to facilitate habitation and travel)?] [(2)]

It is flat and visible to us (i.e. the top) so that people can live on it and be calm (without worry). The fact that it is spherical does not exclude that its surface is not flat because if a large, great thing is flat, it will have a wide back. [(3)]

May Allah enter the Imam into Jannatul Firdaws! His remark is quite obvious for everyone to see.

Third, if after reading Shaikh Abu Iyaad’s post in the aforementioned link you believe that the explanation offered by the other scholars is more persuasive or that the Imam’s position is incorrect, then you should know that every upright Mujtahid is rewarded for striving to reach the correct position, as the Prophet (peace and blessings of Allah be upon him) said, “If a Mujtahid gives a verdict according to the best of his knowledge and his verdict is correct, he will receive a double reward, and if he gives a verdict according to the best of his knowledge and his verdict is wrong, even then he will get a reward”. Finally, when it comes to other matters related to cosmology that are very clear and leave no room for any other opinion, the Imam [may Allah have mercy on him] was very stern about it, and he has every right to be because those who speculate about it have openly contradicted the divine texts. Indeed, the only people who are in disagreement about these matters are those who have either rejected or ignored the proofs and wish to make it a point of contention for others. The upright Salafi Scholars and their students do not have any doubt about these matters; rather, those who abandon or fail to give thorough consideration to the infallible divine texts are the ones plagued by doubts, speculation, and conjecture.
